Sex offenders are one of the most stigmatized groups of offenders in the criminal justice system. The initial penalties for sex crimes include jail time and fines, but even after time is served, a sex offender is branded for life, and their conviction follows them everywhere.

Sex offender registries throughout the country prohibit offenders from basic activities and places such as being near facilities that are deemed as “catering to children” (something that can include churches) or posting on

A sex crime conviction is unlike most other crimes. All criminal records are public, but individuals who are convicted of sex crimes also have to register as a sex offender. The sex offender registry is a separate, public list that not only comes with its own particular stigma, but also additional restrictions regarding things like where you can live and what jobs you can have in the future. Not surprisingly, most people would like to avoid them if they could.

When our blog posts or other resources provide sentencing guidelines for various crimes, they are just that: guidelines. Every case is different, and judges take many different factors into consideration before sentencing someone, including alternative sentencing options and mitigating factors.

Prostitution is illegal in the United States except for 8 counties in Nevada. And even in those 8 counties, prostitution is only legal inside 28 approved brothels. Outside of those brothels, though, prostitution is against the law. Including here in Minnesota.

In Minnesota, sex offenders are required to serve their prison sentence and then be admitted to a “prison hospital” setting to receive treatment in the form of therapy, hormones, and the like.

In June 2015, Federal Judge Frank ruled that this policy for treating sex offenders was unconstitutional. He ordered that instead, sex offenders should be evaluated frequently during their sentence. If necessary, they could then be transferred to the “hospital” for further treatment after serving their time.
