Driving While Intoxicated (DWI) and Driving Under the Influence (DUI) are extremely common charges in Washington County. Driving Under the Influence generally means the State believes the level of consumed alcohol or drugs in your system affected your ability to safely operate a motor vehicle. Driving While Intoxicated generally means the State believes you drove a motor vehicle with a blood alcohol concentration (BAC) at or above 0.08.

 

While every Stillwater DWI/DUI case is different, there are common things every person should know. In most Washington County DWI/DUI cases, the accused has two cases to fight – the criminal charges and the civil license revocation. The criminal charges are more familiar to people charged with DWI/DUI. Criminal charges include potential jail, probation, paying court fines, and having a criminal record if convicted. Minnesota has four levels of DWI/DUI charges: Fourth-Degree DWI, Third-Degree DWI, Second-Degree DWI, and First-Degree DWI also known as Felony DWI. What is less familiar to many is the automatic revocation of the driver’s license following a DWI arrest in Washington County. The Minnesota Department of Public Safety automatically revokes a driver’s license of a person suspected of driving while intoxicated or under the influence (the exact opposite of “innocent until proven guilty”). How long your license will be revoked depends on how high your blood alcohol concentration supposedly was and whether you have any prior DWI criminal convictions or alcohol-related incidents on your driving record. The government automatically revokes your license and to get it back sooner, and remove the blemish from your driving record, you must petition the court within 30 days of your license being revoked.
