Form I-601A Provisional Waivers

Starting March 4, 2013, certain immigrants can apply for a provisional waiver of inadmissibility (to forgive illegal or unlawful entry into the United States) before they must depart the United States to appear at the Consulate or Embassy in their home country to obatin an immigrant visa.

 

The goal of the provisional waiver to keep families together by shortening the length of time the applicant has to return to his or her home country.

 

Applicants are not able to file for provisional waivers until March 4, 2013.

 

In order to be eligible to apply for or to receive a provisional unlawful presence waiver, the applicant must:

 

  • Be an Immediate Relative of a U.S. citizen – meaning the applicant must be the husband or wife, parent or unmarried child under 21 of a U.S. citizen
  • Be at least 17 years old
  • Be physically present in the United States at the time of applying for the waiver
  • Be otherwise admissible (meaning your only issue is that you entered the U.S. unlawfully) Applicants who have criminal issues or other immigration violations cannot use the provisional waivers
  • Be awaiting a consular interview date
  • Be able to prove that the U.S. citizen petitioner will suffer extreme hardship if the waive is not grante

 

Also, individuals who are in immigration court proceedings or who have an order of removal or voluntary departuremay not qualify unless they get special permission from the government and a court order resolvin their case.

 

Even if a waiver is granted, it is “provisional” which means that USCIS has reviewed the case and believes that the waiver should be granted. But there is no guarantee that the immigrant visa case will be successfuly if facts change or new information comes out during the interview at the Embassy.

 

A provisional waiver approval is not legal status. It will not protect you from removal or other consequences of being in the United States without status.

Empezando el 4 de marzo de 2013, ciertos/as inmigrantes pueden aplicar para una exención provisional de inadmisibilidad (para perdonar sus entradas ilegales a los Estados Unidos) antes de que tengan que salir de los Estados Unidos para presentarse en el cónsul o embajada en su país de origen para obtener una visa inmigrante.

 

El objetivo de la exención provisional es mantener las familias juntas por el acortamiento de la duración del tiempo que el solicitante tiene que estar de vuelta en su país de origen y fuera de los Estados Unidos.

 

Los/las solicitantes no pueden aplicar por las exenciones provisionales hasta el 4 de marzo de 2013.

 

Para ser elegible para aplicar por o recibir una exención provisional de presencia ilegal, el/la solicitante tiene que:

 

 

  • Ser un/a pariente directo/a de un/a ciudadano/a Americano/a – queriendo decir que el/la solicitante tiene que ser el esposo, la esposa o hijo/a (no casado/a que tiene menos de 21 años) de un/a ciudadano/a Americano/a.
  • Tener por los menos 17 años.
  • Estar presente físicamente en los Estados Unidos cuando somete la aplicación para la exención provisional
  • Ser admisible en todos otros aspectos (queriendo decir que su único problema es que entró ilegalmente a los Estados Unidos). Solicitantes quienes tienen asuntos criminales u otras violaciones migratorias no pueden usar exenciones provisionales.
  • Estar esperando saber la fecha de su cita para la entrevista consular.
  • Poder probar que el/la peticionario/a sufrirá dificultades extremas si la exención provisional no es concedida.

 

 

También, individuos/as quienes están en procedimientos de inmigración o quienes tienen una orden de deportación o salida voluntaria no califican a menos que obtengan permiso especial del gobierno o una orden de la corte resolviendo su caso.

 

Aunque sea concedida la exención, es “provisional”, que significa que USCIS (Servicios de Ciudadanía e Inmigración de Estados Unidos) ha revisado el caso y cree que la exención debe ser concedida. Pero no hay garantía que el caso de la visa inmigrante terminará con éxito si los hechos cambian o sale nueva información durante la entrevista en la embajada.

 

La aprobación de la exención provisional no es estatus legal. No le protegerá de deportación u otras consecuencias de estar en los Estados Unidos sin estatus.
