What is a Domestic Assault?
Generally, domestic assault occurs when a family member, partner or ex-partner attempts to physically or psychologically dominate or attack another. The difference between a domestic assault and a non-domestic assault is the relationship between the wrongdoer and the victim. The defendant and alleged victim must be “family or household members.”
Who Is Considered a Family or Household Member?
- Spouse or former spouse
- Parent or child
- Person related by blood
- Persons currently living together or previously living together
- Persons who have a child together, whether they former lived together or were married
- A man and woman if the woman is pregnant and the man is alleged to be the father, regardless of whether they have been married or have lived together at any time
- Persons involved in a significant romantic or sexual relationship
What are the Consequences of a Domestic Assault?
Domestic assault charges can result in orders for protection also known as “restraining orders.” A simple misunderstanding between you and your partner can result in your separation. Every domestic assault case is different depending on the dynamics of your household.
If convicted of a domestic assault charge, a defendant can face up to 90 days in jail and/or a $1,000 fine for a misdemeanor and up to 5 years imprisonment and/or a $10,000 fine for a felony. Click here to view Minnesota’s domestic assault statute.
What is Felony Domestic Strangulation?
Since 2005, strangulation is a felony in Minnesota. “Strangulation” means intentionally impeding normal breathing or circulation of the blood by applying pressure on the throat or neck or by blocking the nose or mouth of another person. Click here to view Minnesota’s felony strangulation statute. Domestic Felony Strangulation is a serious charge. Defendants may be imprisoned for up to 3 years and/or pay fines up to $5,000.
