What Happens with a Criminal Sexual Conduct Charge?
If convicted of a Criminal Sexual Conduct charge, a defendant can face between 1 year in jail and 30 years in prison, depending on the severity level of the alleged offense.
In Minnesota, there are six different Criminal Sexual Conduct charges (click the link to view the applicable statute):
- First-Degree Criminal Sexual Conduct (max of 30 years imprisonment and/or a $40,000 fine)
- Second-Degree Criminal Sexual Conduct (max of 25 years imprisonment and/or a $35,000 fine)
- Third-Degree Criminal Sexual Conduct (max of 15 years imprisonment and/or a $30,000 fine)
- Fourth-Degree Criminal Sexual Conduct (max of 10 years imprisonment and/or a $20,000 fine)
- Fifth-Degree Criminal Sexual Conduct (max of 1 year in jail and/or a $3,000 fine)
- Criminal Predatory Sexual Conduct (max of 25 percent longer than the underlying predatory crime maximum)
Criminal Sexual Conduct charges carry social stigmas that can be difficult to overcome. Due to the sensitivity of a sex crime, a conviction may carry several collateral consequences, such as:
- Losing an employment license
- Being barred from certain areas of employment
- Predatory offender registration
- Restitution
- Sex offender counseling or treatment
- Having a smeared reputation
We Will Help You Tell Your Side
Our firm understands that there are two sides to every story. Oftentimes allegations are made against a defendant for reasons other than improper conduct. Adults and children sometimes lie about an incident, causing tremendous potential consequences for the accused. Sometimes a Criminal Sexual Conduct charge arises from a simple misunderstanding between two consenting persons. We understand that having someone falsely accuse you of a crime can be devastating. We are here to help you tell your side of the story and ensure the truth is discovered.
